Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and The Dank Duckery LLC ("we," "us," "our"), a New Hampshire limited liability company, governing your access to and use of DuckeryOS (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Who can use DuckeryOS

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You represent that any information you provide during registration is accurate and that you have the authority to enter into these Terms on behalf of yourself or the farm/business you're registering.

2. Accounts

DuckeryOS is structured as one login per farm, and one farm per login — the Service doesn't currently support multiple staff logins under a single farm account, or a single login managing more than one farm. You're responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at info@thedankduckery.com if you believe your account has been accessed without authorization.

Everything you enter into DuckeryOS — flock records, egg and health logs, breeding data, financial ledger entries, customer and visitor information, and anything else you input ("Farm Data") — belongs to you. We don't claim ownership over it. We store it in a database isolated to your account and access it only as needed to operate, maintain, secure, or provide support for the Service, or as required by law.

You're solely responsible for the accuracy of your Farm Data, including anything relied on for regulatory, certification, or tax purposes. DuckeryOS is a record-keeping tool, not a substitute for professional accounting, legal, veterinary, or regulatory advice — reports and summaries it generates (tax summaries, certification records, pricing worksheets, and similar) are only as accurate as what you enter, and you should have anything used for official or financial purposes reviewed independently.

You can export your Farm Data at any time using the Service's built-in backup/export feature. If you cancel your account, we'll retain your Farm Data for a limited period in case you wish to export it or reactivate, then delete it — see our Privacy Policy for details.

We may suspend or terminate accounts that violate these Terms, misuse the Service, or fail to pay applicable fees.

6. Availability

We aim to keep DuckeryOS available and reliable, but we don't guarantee uninterrupted access. The Service may be unavailable at times for maintenance, updates, or circumstances outside our control. We recommend maintaining your own periodic exports of your Farm Data as a precaution, independent of any backups we perform.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We don't warrant that the Service will be error-free, secure, or uninterrupted, or that any report, calculation, or summary it produces is accurate or suitable for any particular regulatory, tax, or certification purpose.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DANK DUCKERY LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless The Dank Duckery LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your Farm Data, or your violation of these Terms.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll make reasonable efforts to notify account holders (such as by email or a notice within the Service) before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the State of New Hampshire, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in New Hampshire.
